Open Consultation on Proposed Changes to College Bylaws

The College is proposing changes to its bylaws. The purpose of the proposed changes is to:

  • remove unnecessary duplication of current requirements in the Regulated Health Professions Act, 1991 (RHPA)
  • ensure College bylaws are consistent with recent amendments to the RHPA

The College is required by law to ask registrants for your input on these proposed changes, even though some of the changes result from changes to the RHPA that are already in effect. To meet our legal requirements we are required to consult with our registrants. Changes have been, or will be, implemented as they are required by law.

Please note: The proposed changes listed in questions 2, 3 and 4 of the survey are required by law. We welcome your comments, however any feedback we receive about these questions will not change the outcome of this consultation.

The consultation will close at 4:00 pm on Friday, May 11, 2018. A summary of consultation feedback will be provided to College Council for review.

Summary of Proposed Changes:

  • Part 16 Information to Be Provided by Registrants – an editorial change revising the phrase “of this bylaw” to ‘of these bylaws’

  • Part 17 Public Register – content changes to:
    • clarify the trigger date to align with the RHPA’s requirements for publication of information about Specified Continuing Education or Remedial Programs (SCERPs) or oral caution outcomes issued by the Inquiries, Complaints and Reports Committee;
    • clarify in what circumstances information published about undertakings will be removed from Find an Occupational Therapist, outside of those already provided for in the RHPA; and,
    • delete a provision that duplicates information already defined in the RHPA.

  • Part 20 Therapy and Counselling for Sexual Abuse – deletion as the Part 20 provision is redundant and not required for the College to maintain its existing program to provide funding. Authority for the College to maintain its existing program to provide such funding already exists within regulation (Ontario Regulation 226/96: General) and the RHPA.
